Article 2 – Scope

These terms apply to sales concluded on the website blueportance.com between Blue Portance and any natural person acting for purposes outside their trade or profession (the “Customer”).

Professionals (practitioners, institutions, companies) are invited to contact Blue Portance for suitable terms.

Placing an order implies acceptance of these terms, which the Customer acknowledges having read before confirming the order.

Article 3 – Products

The products offered are seats (chairs and stools) and cushions from the Aporia® range, together with their accessories. Their essential characteristics (dimensions, weight, composition, firmness options, care) are set out on each product page.

Aporia® products are not medical devices. They act on the mechanical conditions of sitting. They do not treat any condition and do not replace medical advice.

Photographs are as accurate as possible; slight differences in appearance, in particular due to the screen used, may exist.

Products are offered while stocks last. An unavailable product is indicated as such on its product page.

Article 4 – Prices

Prices are shown in euros, including all taxes (VAT included), excluding delivery costs. The applicable delivery costs are shown before the order is confirmed (Article 7).

For deliveries outside the European Union, including Switzerland, import duties and taxes may be charged on receipt. They remain payable by the Customer.

The price invoiced is the price displayed when the order is confirmed.

Article 5 – Ordering

The Customer selects the product and its options (version, firmness), checks the contents of the cart, enters their contact details and delivery address, then confirms the order with an obligation to pay.

Before confirming, the Customer can check the details of the order and its total price, and correct any errors.

A confirmation email summarizing the order is sent to the Customer. Ordering requires the creation of a customer account, in which the Customer can view the history and tracking of their orders.

Blue Portance may refuse or cancel an order in the event of an existing dispute with the Customer, non-payment or suspected fraud. Any amount already paid is then refunded in full.

Article 6 – Payment

Payment is due when the order is placed. It is made by bank card (Visa, Mastercard) via Stripe, by PayPal or by Klarna (payment in 3 interest-free installments). Payment in installments is subject to acceptance by Klarna and to its own terms. Payments are secure; Blue Portance has no access to the Customer’s banking data.

Depending on their bank, the Customer may have to confirm the payment through strong authentication.

Article 7 – Delivery

  • Metropolitan France: free delivery.
  • Other European Union countries: flat rate of €20 per order.
  • Switzerland: flat rate of €30 per order.
  • United Kingdom and other non-EU countries: costs shown when ordering.

Delivery takes 8 to 10 working days from the order, unless otherwise stated on the product page or when ordering. Each product is prepared and inspected in France before shipping. A tracking email is sent as soon as the order ships.

The risk of loss or damage passes to the Customer when they take physical possession of the product.

In the event of late delivery, the Customer may, after requiring Blue Portance to deliver within a reasonable additional period, terminate the sale if that period is not met, in accordance with Articles L216-6 et seq. of the French Consumer Code. The Customer is then refunded all sums paid.

On receipt, the Customer is invited to check the condition of the parcel and to report any damage or missing product to Blue Portance as soon as possible, with photos.

Article 8 – Statutory right of withdrawal (14 days)

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the product to withdraw from the contract, without having to give any reason.

To exercise this right, the Customer informs Blue Portance of their decision by an unequivocal statement, by email to contact@blueportance.com or using the form below. Blue Portance then sends the return instructions and label. Return costs are borne by Blue Portance for returns from metropolitan France.

Blue Portance refunds all sums paid, including the initial delivery costs, no later than 14 days after being informed of the Customer’s decision. It may withhold the refund until it has received the product or until proof of its dispatch has been provided.

The Customer may be held liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning. The 30-day trial provided for in Article 9, by contrast, allows real use of the product.

Withdrawal form (complete and return only if the Customer wishes to withdraw):

To Blue Portance SAS, 6 Impasse des Vallières, 06800 Cagnes-sur-Mer, France – contact@blueportance.com. I hereby give notice that I withdraw from my contract for the sale of the following goods: – ordered on [date] / received on [date] – Name of consumer – Address of consumer – Signature (only if this form is notified on paper) – Date.

Article 9 – 30-day trial, satisfied or refunded

In addition to the statutory right of withdrawal, Blue Portance grants the Customer a 30-day trial from receipt, to use the product in real sitting conditions: at the office, in the car, at home.

If the product does not suit them, the Customer contacts Blue Portance before sending anything back, by email or by phone. Blue Portance sends the return instructions and label. Returns are free from any European Union country; from a country outside the European Union, return costs are borne by the Customer.

The product is returned complete (base, four supports, cover, wedges and accessories delivered), clean and undamaged.

The refund is made in full, to the payment method used for the order. It is issued within 14 days of receipt and inspection of the returned product.

During the trial, Blue Portance offers the Customer personalized support with getting started (wedge adjustment, choice of firmness, gradual use).

Article 10 – Exchange

Within the 30-day trial period, the Customer may ask to exchange the product for another version or another firmness. The original product is returned under the conditions of Article 9. Shipping costs for the new product are borne by the Customer.

If the new product has a different price, the difference is invoiced or refunded to the Customer. The product received in exchange benefits from a new 15-day trial period from its receipt, under the conditions of Article 9.

Article 11 – Legal guarantees

Independently of the 30-day trial, all products benefit, as of right and at no extra cost, from:

  • the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): for 2 years from delivery, the Customer may obtain the repair or replacement of a non-conforming product or, failing that, a price reduction or termination of the sale. Any defect appearing within this period is presumed to have existed at the time of delivery;
  • the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code): for 2 years from the discovery of the defect, the Customer may request termination of the sale or a price reduction.

Information box on the legal guarantees (model A of the annex to Article D. 211-2 of the French Consumer Code):

The consumer has two years from delivery of the goods to obtain implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.

Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service over a period exceeding two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience to the consumer.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and be refunded in full against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;

4° The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

To implement these guarantees, the Customer contacts customer service (Article 12), with photos where possible. If bringing the product into conformity requires it to be sent back, Blue Portance sends the Customer the instructions and return label for shipment by post, at Blue Portance’s expense.

Article 12 – Customer service and complaints

For any question or complaint: contact@blueportance.com or +33 6 15 77 81 36, Monday to Friday, 9 a.m. to 5 p.m. Paris time. Blue Portance undertakes to reply as quickly as possible.

Article 13 – Consumer mediation

In the event of a dispute not resolved after a written complaint to Blue Portance, the Customer may refer the matter free of charge to the following consumer mediator, within one year of their written complaint:

CM2C (Centre de la médiation de la consommation de conciliateurs de justice) – 49 rue de Ponthieu, 75008 Paris, France – www.cm2c.net – contact@cm2c.net – +33 1 89 47 00 14. The Customer may submit the dispute directly on CM2C’s online platform.

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, the mediator informs the parties of the proposed solution within ninety days of being notified of the referral; this period may be extended for complex disputes. The proposal is not binding on the parties: the Customer remains free to accept or refuse it and retains the right to bring the matter before the competent court. Recourse to mediation suspends the limitation period for the action under the conditions of Article 2238 of the French Civil Code.

Article 14 – Personal data

Data collected when ordering (identity, contact details, delivery address, order history) is processed by Blue Portance SAS, as data controller, for order management, delivery, customer service and, with the Customer’s consent, sending marketing information. It is kept for as long as necessary for these purposes and to comply with legal obligations. Payment data is processed directly by the payment providers (Stripe, PayPal, Klarna); Blue Portance has no access to it.

In accordance with the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify, erase, restrict, object to the processing of and port their data. These rights are exercised by writing to contact@blueportance.com. The Customer may also lodge a complaint with the CNIL, the French data protection authority (www.cnil.fr).

Article 15 – Intellectual property

The Aporia® trademark and the texts, visuals and content of the website are the property of Blue Portance or of their authors. Any reproduction without authorization is prohibited. The architecture of Aporia® seats is protected by French patent FR 3 140 745 B1.

Article 16 – Governing law and disputes

These terms are governed by French law. Failing an amicable or mediated resolution, the dispute is brought before the competent court under the ordinary rules of law. A consumer Customer may in particular refer the matter to the court of the place where they resided when the contract was concluded.

The French version of these terms prevails in the event of any discrepancy with a translation.
